IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY BEFORE USING ELECTION BEACON. BY CHECKING THE ACCEPTANCE BOX OR USING THE PLATFORM, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS, INCLUDING THE MANDATORY ARBITRATION CLAUSE AND CLASS ACTION WAIVER IN SECTION 14. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.
These Terms of Service and User Agreement (“Agreement”) constitute a legally binding contract between you (“User,” “you,” or “your”) and Circino Inc., a Kentucky C corporation (“Circino,” “we,” “us,” or “our”), governing your access to and use of Election Beacon, including its website, platform, surveys, matching features, and any related services (collectively, the “Platform”).
By creating an account, completing a survey, purchasing a subscription, or otherwise accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by this Agreement and our Privacy Policy, which is incorporated herein by reference.
We strongly recommend that you accept this Agreement by actively checking the acceptance checkbox presented to you before using the Platform. This active acceptance is the clearest evidence of your agreement to these terms and provides the strongest legal protection for both parties.
If you are using the Platform on behalf of an organization or campaign, you represent that you have the authority to bind that organization to this Agreement.

By using the Platform, you represent and warrant that you meet all of the above eligibility requirements. If you do not meet these requirements, you must not use the Platform.
Election Beacon is a civic engagement platform that matches voters with United States federal election candidates based on similarities in survey responses. The Platform operates as follows:
Election Beacon is an independent, nonpartisan civic technology platform. We are not affiliated with any political party, campaign, government agency, or election authority.
Free users may access the Platform anonymously without creating an account or providing personal information. Free users may complete the survey and receive candidate match results. Free users do not have access to profile creation, saved results, or premium features.
Paid subscribers may create a profile, save their results, and access additional features as described on the Platform at the time of purchase. By purchasing a subscription, you agree to provide accurate billing information and authorize us to charge the applicable fees.
Subscription fees are billed on a recurring basis as disclosed at the time of purchase. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. We do not offer refunds for partial billing periods except as required by applicable law.
We reserve the right to modify subscription pricing with at least 30 days written notice to current subscribers. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
THE MATCH RESULTS PROVIDED BY ELECTION BEACON ARE FOR INFORMATIONAL AND CIVIC ENGAGEMENT PURPOSES ONLY. THEY DO NOT CONSTITUTE A VOTING RECOMMENDATION, POLITICAL ENDORSEMENT, OR PROFESSIONAL ADVICE OF ANY KIND.
Match results are generated algorithmically based solely on survey responses submitted by candidates and voters. The accuracy, completeness, and reliability of match results depend entirely on the accuracy of the information submitted by candidates and voters. Circino Inc. makes no representation or warranty that:
You acknowledge and agree that any voting decision, political action, or other decision you make based on Election Beacon match results is made entirely at your own risk and discretion. Circino Inc. expressly disclaims any responsibility for decisions made by users in reliance on match results.
By using the Platform, you agree not to:
Circino Inc. reserves the right to suspend or permanently terminate access to the Platform for any user who violates these prohibitions, without notice and without refund of any prepaid fees.
Candidates who participate in Election Beacon by completing surveys represent and warrant that:
Circino Inc. does not verify the identity of candidates or the accuracy of their survey responses. We are not responsible for false or misleading information submitted by candidates. Any candidate found to be impersonating another candidate or submitting knowingly false information may be removed from the Platform and reported to appropriate authorities.
Candidate profiles are maintained on the Platform for the duration of the active election cycle in which the candidate is participating. In the event that a candidate withdraws from their race or does not advance past the primary election, their profile will be removed from the Platform within 14 days of confirmed status change. Candidate status is verified through official sources including FEC filings and certified election authority records. Where official confirmation is unavailable, Circino Inc. will contact the candidate’s campaign directly to confirm status before any profile removal. The candidate will be notified via email prior to removal.
All content on the Platform, including but not limited to the matching algorithm, survey questions, design, graphics, text, logos, and software, is the exclusive property of Circino Inc. or its licensors and is protected by United States copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for its intended civic engagement purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from the Platform without our prior written consent.
By submitting survey responses or other content to the Platform, you grant Circino Inc. a worldwide, royalty-free, perpetual license to use, store, process, and display that content solely for the purposes of operating the Platform and as described in our Privacy Policy.
Your use of the Platform is also governed by our Privacy Policy, available at www.electionbeacon.com/privacy, which is incorporated into this Agreement by reference. By using the Platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CIRCINO INC. DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Circino Inc. does not warrant that:
Your use of the Platform is entirely at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CIRCINO INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.
Without limiting the foregoing, Circino Inc. specifically disclaims all liability for:
In any case where liability cannot be fully excluded, Circino Inc.’s total cumulative liability to you for all claims arising out of or related to this Agreement or the Platform shall not exceed the greater of (a) the total amount you paid to Circino Inc. in the twelve months preceding the claim, or (b) one hundred US dollars ($100.00).
You agree to defend, indemnify, and hold harmless Circino Inc. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
Circino Inc. reserves the right to modify, suspend, or discontinue the Platform or any part of it at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
We may update this Agreement from time to time. When we make material changes, we will notify you by email (if you are a registered user) or by posting a prominent notice on the Platform at least 14 days before the changes take effect. Your continued use of the Platform after the effective date of any update constitutes your acceptance of the revised Agreement. If you do not agree to the updated terms, you must stop using the Platform.
THIS SECTION SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS. PLEASE READ IT CAREFULLY.
Except as provided in Section 14.3, you and Circino Inc. agree that any dispute, claim, or controversy arising out of or relating to this Agreement, the Platform, or your use thereof (“Dispute”) shall be resolved exclusively through final and binding individual arbitration, rather than in court.
Arbitration shall be conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall take place in Louisville, Kentucky, or by remote means if mutually agreed. The arbitrator shall apply Kentucky law consistent with the Federal Arbitration Act.
The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall be responsible for its own attorneys’ fees unless the arbitrator determines that a claim was frivolous or brought in bad faith.
YOU AND CIRCINO INC. EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING OF ANY KIND. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY.
You agree that you may not bring or participate in any class action lawsuit, class-wide arbitration, private attorney general action, or any other representative or consolidated proceeding against Circino Inc. If this class action waiver is found unenforceable for any reason, the entirety of Section 14.1 shall be null and void, and any dispute shall be resolved in a court of competent jurisdiction in Kentucky.
Notwithstanding the above, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration. Additionally, either party may bring an individual claim in small claims court in Kentucky if the claim qualifies.
You have the right to opt out of this arbitration agreement by sending written notice to legal@electionbeacon.com within 30 days of first accepting this Agreement. Your notice must include your name, email address, and a clear statement that you are opting out of arbitration. Opting out of arbitration does not affect any other provision of this Agreement.
Before initiating arbitration, you agree to first contact us at legal@electionbeacon.com and describe your Dispute in reasonable detail. We will attempt to resolve the Dispute informally within 30 days. If we cannot resolve it within that timeframe, either party may proceed to arbitration.
This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law principles. To the extent that any dispute is not subject to arbitration under Section 14, you and Circino Inc. consent to the exclusive jurisdiction of the state and federal courts located in Jefferson County, Kentucky.
Circino Inc. may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of this Agreement, fraudulent activity, or conduct that we determine to be harmful to the Platform or its users.
You may terminate your account at any time by contacting us at support@electionbeacon.com. Upon termination, your right to access the Platform ceases immediately. Sections 5, 8, 10, 11, 12, 14, and 15 of this Agreement shall survive termination.
This Agreement, together with the Privacy Policy, constitutes the entire agreement between you and Circino Inc. regarding the Platform and supersedes all prior agreements, understandings, and representations.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
Circino Inc.’s failure to enforce any provision of this Agreement shall not constitute a waiver of that provision or any other provision.
You may not assign or transfer your rights or obligations under this Agreement without Circino Inc.’s prior written consent. Circino Inc. may freely assign this Agreement in connection with a merger, acquisition, or sale of assets.
Circino Inc. shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, cyberattacks, or other events outside our control.
Nothing in the Platform or this Agreement constitutes an endorsement of any candidate, political party, policy position, or electoral outcome by Circino Inc. Election Beacon is an independent, nonpartisan service.

USER ACCEPTANCE
By checking the acceptance checkbox on the Platform and using Election Beacon, you acknowledge that:
Implementation note for Circino Inc.: Present users with a clearly visible checkbox stating “I have read and agree to the Terms of Service and User Agreement” before allowing access to the survey or any Platform features. Log the timestamp of acceptance along with the user’s IP address for evidentiary purposes.
LEGAL NOTICE: This Terms of Service and User Agreement was prepared as a general template for Election Beacon / Circino Inc. and should be reviewed by a qualified attorney licensed in Kentucky before publication. Laws governing arbitration clauses, class action waivers, and civic technology platforms are subject to change. Circino Inc. is solely responsible for ensuring this Agreement complies with all applicable federal and state laws.
